10:00 – 11:30 – Presentation by representatives from the TN Dept. of Labor & Workforce Development Appeals Tribunal – the Department representatives will talk about current issues including appeals, overpayments, access problems, audits, delays in adjudication and give information about department contacts for specific issues.
11:30 – 12:00 – Legislative update – Stewart Clifton and Mike Murphy – TALS legislative liaisons
12:00 – 12:30 – Lunch
12:30 – 1:30 – Unemployment Compensation Overpayments –presenters will discuss what rights an individual has to notice and appeal and the right to request a waiver of the overpayment. The session will review situations that may result in an overpayment and the significance of a fraud determination. They will cover what collection tools and tactics the Department of Labor and Workforce Development uses to collect overpayments. Presentation by: Janet Mynatt and Norm Feaster – staff attorneys for the Legal Aid Society of Middle TN & the Cumberlands
1:30 – 3:00 – Discussion of unemployment compensation including hearsay review; evidentiary, health and hearing issues; FMLA and ADA issues that may arise in the context of the UI cases – Presentation by:
David Kozlowski –Legal Aid Society of Middle TN & the Cumberlands managing attorney for the Columbia office;
Andrae Crismon - Legal Aid Society of Middle TN & the Cumberlands managing attorney for the Murfreesboro office;
Bill Bush - Legal Aid Society of Middle TN & the Cumberlands staff attorney for the Oak Ridge
